The Kroger prescription pricing case is pending in the U.S. District Court for the Southern District of Ohio (2:21-cv-00022). The plaintiffs argue that Kroger should have factored its Savings Club prices into the "usual and customary" price it reports to insurers, and that leaving them out pushed up what insured customers paid at the counter.
Kroger says it reported its prices correctly and denies wrongdoing. The parties settled for $17 million, and claims are open until December 21, 2026.
What the plaintiffs say happened
Pharmacies report a usual and customary price for each drug. Insurers use it to set copays and reimbursement. The complaint alleges that Kroger's Savings Club offered lower prices to members, that those prices should have counted as usual and customary, and that insured customers paid more as a result. The court has not decided whether the plaintiffs are right.

Status and how payment is figured
The settlement is in the claims phase. After court-approved fees and costs come out of the $17 million fund, the remainder is split among valid claims in proportion to eligible prescription spending. People with larger insured prescription bills during the class period get a larger share.
