McCulley v. Banner Health is a class action over tracking code on the MyBanner patient portal. The complaint alleged that Meta Pixel, Google Analytics tags, and similar tools on the portal passed protected health information to Meta, Google, and other outside companies, without patients agreeing to it.

Banner Health has not admitted wrongdoing. It settled with a class of roughly 1,028,000 patients who held a MyBanner account and logged in between June 1, 2020 and November 22, 2023.

The lawsuit described a pattern that has shown up at hospital systems across the country. Marketing pixels placed on logged-in pages can transmit which pages a patient views and what they click, which in a medical portal can reveal conditions, providers, and appointments. The plaintiffs argued this violated state privacy laws and consumer protections tied to HIPAA.

Banner denied the claims, and the settlement resolves them without a ruling on the merits.
