The two lawsuits behind the Equinox breach settlement, and who can file

Two lawsuits, McHugh v. Equinox, Inc. and Carter v. Equinox, Inc., settled together for $685,000 over a data breach on April 29, 2024. Members who received a written breach notice from Equinox can file at EquinoxIncSettlement.com through October 23, 2026.
The plaintiffs said Equinox failed to protect member data. The exposed fields were unusually broad for a gym: names, addresses, dates of birth, Social Security numbers, driver's license numbers, health insurance details, medical treatment and diagnosis records, medication information, financial account data, provider names, and patient IDs.
Equinox denies wrongdoing. Final approval has not yet been granted.
The notice letter is the ticket in
Eligibility is limited to people who got a written breach notice from Equinox after the April 2024 incident. That letter contains a unique notice ID, and the online claim form requires it. Without the ID you cannot complete the form.
You also need to be a U.S. resident.
Status and dates
- Claim deadline: October 23, 2026, online or by mail.
- Final approval hearing: November 12, 2026.
- Payment: an estimated $100 pro rata payment with no documents, or up to $5,000 for documented losses with receipts, statements, or fraud correspondence attached. The $100 figure moves with the number of valid claims.
What else is in the settlement
Class members can enroll in three years of one-bureau credit monitoring, dark web monitoring, and up to $1 million in identity theft insurance at no cost, whether or not they claim cash.
After you file
The settlement administrator checks the notice ID against its records, reviews any loss documentation, and issues a confirmation number. Nothing is paid until after the November 12, 2026 hearing and the approval order becomes final.
