WhatsApp encryption lawsuit, not yet taking claimants

Dawson et al. v. Meta Platforms, Inc. et al. (Case No. 3:26-cv-00751-RFL) was filed January 23, 2026 in the U.S. District Court for the Northern District of California. The 51-page, 10-count complaint says Meta stores, analyzes, and keeps access to WhatsApp messages despite marketing the app as end-to-end encrypted.
There is no claim form and no settlement. The proposed class excludes users in the U.S., Canada, the UK, and the EU because of arbitration and jurisdiction clauses in WhatsApp's terms. Intake would open only after a court-approved settlement or judgment.
