Milberg is investigating Commonwealth Financial Network's cash sweep programs and is taking sign-ups from brokerage clients whose idle cash was swept into low-yield bank accounts. This is an attorney-advertising intake for a case still under investigation, not a settled class action.

A cash sweep moves uninvested cash in a brokerage account into a bank deposit account automatically. The allegation is that Commonwealth's sweep accounts paid as little as 0.01% while money market funds paid substantially more, and that the banks kept the spread.

No court, case number, or deadline has been published for this matter. The intake page is the only place to add your name.

The allegation in plain terms

Clients had a choice of sweep options, and Milberg says many did not understand the difference between them. Cash parked at 0.01% earns almost nothing. The gap between that rate and a money market yield went to the bank, with the client seeing none of it.

If a class action is filed and certified, clients could pursue their actual losses. The intake page also notes that class representatives may, at the court's discretion, receive $1,000 to $10,000 on top of any damages. That figure applies only to named representatives, and only if a court awards it.

Current status

  • Stage: investigation by Milberg. No complaint, court, or docket number is listed.
  • No filing deadline has been announced. Statutes of limitation still apply, which is why the firm frames the window as limited.

Who the firm is looking for

Commonwealth Financial Network brokerage clients who held uninvested cash that was swept into a bank deposit program. The intake form asks about your account and the period you held it. Milberg reviews submissions and decides whether to follow up.

What happens after you sign up

Submitting the form sends your information to Milberg for review. It does not make you a client, create an attorney-client relationship, or promise any recovery. If the firm takes your matter, representation happens under a separate written agreement.

The intake is free. Payout, a free settlement-finder app, lists this intake as well, but you can go to the Milberg page directly.
