What happens between preliminary and final approval
Preliminary approval comes first. The judge reads the agreement, decides it is worth telling the class about, and authorizes the notice program. Brooklyn Bedding's mattress settlement got that order on June 26, 2026, with the final hearing calendared for October 16, 2026.
In between, the administrator sends notices, opens the claim site, and collects claims, objections, and opt-outs. Class members who dislike the deal can object in writing and appear at the hearing. The judge wants those numbers before ruling, which is why the claim deadline often lands a few weeks ahead of the hearing.
What the judge weighs
- The size of the fund against what the class could have won at trial, discounted for the risk of losing.
- How many people claimed, objected, or opted out.
- Whether the notice actually reached the class.
- Attorney fees and service awards to the named plaintiffs, which come out of the fund.
- Whether the plan for dividing the money treats similar people similarly.
Why the date moves
Court calendars change. A judge may push the hearing because another trial takes priority, because the parties ask for time to answer objections, or because the notice program ran late. Comcast's Xfinity hearing was set for August 5, 2026 in Philadelphia while claims stayed open to September 14, 2026.
A moved hearing rarely changes the claim deadline. If you filed before the original date, your claim stands. Payment is what moves with the hearing. Administrators start paying weeks to months after final approval, and later if someone appeals. Guitar Center's notice says payments follow the October 2, 2026 hearing barring any appeal, which is the standard wording.
What you can do while you wait
File before the claim deadline and keep the confirmation number. Check the administrator's site once a month for a new hearing date or an approval order, since administrators post those on the case page. If you move, update your address with the administrator, because a check mailed to an old address is a common reason a valid claim goes unpaid.
